College PC Geeks, LLP Terms & Conditions

These Terms and Conditions govern the use of the College PC Geeks, LLP website (the “College PC Geeks, LLP Site”) and related products and services by clients which have not entered into a separate Sales Order or Sales Orders for the applicable services (which are referred to in these Terms & Conditions as “Clients”), and they provide notice to Clients of certain College PC Geeks, LLP policies. College PC Geeks, LLP, Inc. (“College PC Geeks, LLP”) reserves the right to modify these Terms & Conditions from time to time, and Clients’ use or continued use of the College PC Geeks, LLP Site or College PC Geeks, LLP products or services means that Clients is aware of and agrees to comply with the current version of these Terms & Conditions.

Services and Payment

Clients and College PC Geeks, LLP agree that College PC Geeks, LLP will provide or make available to Clients the products and services ordered by Clients (the “Services”) through the College PC Geeks, LLP Site. Clients agrees to pay for all of the Services at the prices and rates agreed to at the time the applicable Services are ordered, with College PC Geeks, LLP having the right to adjust pricing for month to month services packages from time to time. Payment will be made by credit card or other payment form specifically approved by College PC Geeks, LLP. If any such payment is not paid when due, Clients agrees to pay College PC Geeks, LLP interest on such overdue payment at 5% per month and to reimburse College PC Geeks, LLP on demand for all costs of collection incurred by College PC Geeks, LLP, including, without limitation, reasonable attorneys’ fees and costs.

Credit Card Refund Policy

Clients may request a credit card refund by contacting College PC Geeks, LLP by phone at 1-866-245-4678 or in writing at 1225 Laurel Street, Ste 315, Columbia, SC 29201. Please direct all requests to the attention of accounting. Client acknowledges that posting fees may be non-refundable if College PC Geeks, LLP’s current rules and processes are violated.

Client’s Responsibilities

The College PC Geeks, LLP Site may be used only for lawful purposes by individuals seeking technology consulting and related services. Clients may not use (or plan, encourage or help others to use) the College PC Geeks, LLP Site for any purpose or in any manner that is prohibited by these Terms & Conditions or by applicable law or regulation (including but not limited to any applicable export controls). It is Client’s responsibility to ensure that its use of the College PC Geeks, LLP Site complies with these Terms & Conditions and to seek prior written permission from College PC Geeks, LLP for any uses not permitted or not expressly specified herein.
In connection with using the College PC Geeks, LLP Site, Clients will not:

Limited License

College PC Geeks, LLP grants Clients a nonexclusive, nontransferable, limited license to use the College PC Geeks, LLP Site to the extent necessary for Clients to receive and use the Services.

College PC Geeks, LLP Intellectual Property

College PC Geeks, LLP or its licensor is the owner of all intellectual property rights (including, without limitation, all copyrights) in and to the College PC Geeks, LLP Site and all related software, all visual images, tag lines, and other content and materials included in or used in connection with the College PC Geeks, LLP Site and all products and services offered in or through the College PC Geeks, LLP Site (the “College PC Geeks, LLP Intellectual Property”). Except for the limited license specifically granted to Clients by these Terms & Conditions, nothing in these Terms & Conditions is intended to grant or should be construed as granting to Clients or any other person or entity any license or other right in or to any of the College PC Geeks, LLP Intellectual Property. The deletion or alteration of any copyright or other proprietary notices from the College PC Geeks, LLP Site is strictly forbidden.
In addition, "College PC Geeks, LLP" and certain other names and logos are trademarks of College PC Geeks, LLP, Inc., and all related product and service names, design marks and slogans are the trademarks or service marks of College PC Geeks, LLP, Inc. All other product and service marks contained herein are the trademarks of their respective owners. The "look and feel" of the College PC Geeks, LLP Site (including color combinations, button shapes, layout, design and all other graphical elements) is also College PC Geeks, LLP Intellectual Property.
All editorial content and graphics on the College PC Geeks, LLP Site, as well as the HTML based computer programs used to generate pages, are protected by U.S. copyright laws and international treaties and may not be copied without the express permission of College PC Geeks, LLP, which reserves all rights. Re-use of any of College PC Geeks, LLP's editorial content and graphics for any purpose is strictly prohibited without College PC Geeks, LLP’s prior written permission. Indemnity

Clients agrees to indemnify, defend and hold College PC Geeks, LLP harmless from and against any damages, costs and expenses (including reasonable attorneys’ fees) incurred by College PC Geeks, LLP as a result of or in connection with any third-party claim that any of the Clients Materials infringes or otherwise violates the copyright or other intellectual property rights of a third party and/or that Client’s employee screening or other hiring practices violate any applicable law.

Computer Repair Guarantee

We guarantee computer services provided to you at your residence of service, at any College PC Geeks store front location, remote or via phone support for 30 days. Any repairs associated with the form of a virus or spyware, the service guarantee is only valid, if the anti-virus and anti-spyware protection for the product was installed or updated during the repair or before any reoccurrence of internet connection.

Privacy

At College PC Geeks you can be assured that your best interest is our best interest.  We want you to know that we are working to protect your rights and private information according to all federal and state privacy laws.  We not only follow the govern laws, but a strict audit policy that assures our technicians our following all policy and procedures 100%.

Protection of Personal Information

Your personal information is very serious; therefore we prepare all technicians to assure that they best protect it. If any; technicians, customer service or College PC Geeks representative request personal data, they will provide you the reason for their request.

Warranties

College PC Geeks, LLP warrants that the Services will be provided in a professional manner substantially in accordance with prevailing industry standards. Warranties are as follows for labor and hardware issues performed by College PC Geeks, LLP.

• 30 day warranty on all labor services performed.
• Virus Removals are only warrantied for the removal of pre-existing virus on original repair service performed on the PC. After the original Virus Removal, Microsoft Security Essentials (Anti-Virus protection and prevention software) will be uploaded/upgraded to the client's PC.
• Hardware repairs will include warranties provided by each product's/part's manufacturer.

College PC Geeks, LLP does not provide a warranty on any service repair except for issues that fall under "Manufacture's Warranty". Issuing pertaining to hardware will be honor as long as all manufacture's requirements are met to fulfill such a warranty issue. Replacement parts will be sent to College PC Geeks' office for installation. Lead time for replacement parts will vary due to different manufacture standards and procedures for warranty issues.

Liability Limitation

EXCEPT AS OTHERWISE PROVIDED IN THE INDEMNITY SECTION ABOVE AND WITHOUT LIMITING CLIENT’S OBLIGATION TO PAY FOR THE SERVICES, (a) NEITHER CLIENTS NOR COLLEGE PC GEEKS, LLPWILL BE LIABLE FOR ANY PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, AND EACH OF CLIENTS AND COLLEGE PC GEEKS, LLP IRREVOCABLY WAIVES ANY RIGHT TO COLLECT ANY SUCH DAMAGES, AND (b) THE MAXIMUM LIABILITY FOR DAMAGES HEREUNDER WILL NOT EXCEED THE AMOUNT PAID OR PAYABLE BY CLIENTS TO COLLEGE PC GEEKS, LLP HEREUNDER.

Termination

In the event that Clients violates or fails to comply with any provision of these Terms & Conditions and such violation or failure is not cured promptly after Clients receives written notice from College PC Geeks, LLP, or in the event that Clients uses or accesses or attempts to use or access the College PC Geeks, LLP Site other than for its intended purpose in connection with receiving and using the Services, College PC Geeks, LLP will have the right to suspend providing the Services and/or to revoke Client’s license to use the College PC Geeks, LLP Site. No such termination will limit or otherwise affect Client’s obligation to pay for all remaining Services.

Third Party Services

College PC Geeks, LLP may be the re-seller of or may otherwise make available to customers products or services owned by third parties (“Third Party Products and Services”) through the College PC Geeks, LLP Site. The College PC Geeks, LLP Site may also contain links or other connections to websites owned or operated by third parties (“Third Party Sites”). Clients acknowledges and agrees that College PC Geeks, LLP makes no representations or warranties regarding, and has and will have no liability or responsibility for, any such Third Party Products and Services or Third Party Sites.

Miscellaneous

These Terms & Conditions will be construed in accordance with and governed by the laws of the Commonwealth of South Carolina. Clients and College PC Geeks, LLP specifically agree that the Circuit Court of South Carolina or the United States District Court for South Carolina will have exclusive jurisdiction over any suit, action, proceeding, complaint or other dispute between the parties arising out of or relating to these Terms & Conditions, and any such suit, action or proceeding will be brought only in one of such courts. No modification, amendment or waiver of any provision of these Terms & Conditions will in any event be effective unless it is in writing and signed by College PC Geeks, LLP.
